01These terms

These terms are an agreement between you and Mezurio (“we”, “us”), the publisher of the Mezurio app and of the website mezurioapp.com. They apply whenever you use either. By downloading or using Mezurio you agree to them. If you do not agree, please do not use it.

How we handle information is described in our privacy policy, which forms part of this agreement.

02Who can use Mezurio

You may use Mezurio if you can form a binding agreement with us and are not barred from doing so by the law that applies to you. To create an account you must be at least 18 years old.

Children do not use Mezurio on their own account. If you add a child to the app, you confirm that you are the child’s parent or guardian, or that you have that person’s permission.

03What Mezurio is

Mezurio keeps body measurements and sizes for you and the people you buy or sew for, shows them on a 3D figure, and helps you find them or send them when they are needed. It works on your phone without an account; an account adds backup and sync.

It is not a medical product. Nothing in the app is medical advice, a diagnosis or a treatment: not the growth percentiles, not the body-composition figures, not a goal, not the shape of the 3D figure. Do not rely on it for any decision about health. If you have a question about your health or a child’s growth, ask a doctor.

04Sizes and estimates

Much of what the app shows is worked out from what you entered, and is only as good as the measurement behind it:

• clothing, shoe, ring and bra sizes, and their conversions between EU, US and UK systems, are approximate, and brands cut differently;
• the 3D figure is a likeness built from your numbers, not a scan of anyone;
• “next size” dates and hand-me-down suggestions for children are forecasts, and children do not always follow them;
• numbers read from a photo of a body-composition result can be misread: check them before you save.

Before you buy something, or have something made, check the seller’s or the tailor’s own measurements. We are not responsible for a garment that does not fit.

05Your licence to use the app

We give you a personal, non-exclusive, non-transferable licence to install and use the Mezurio app on devices you own or control, for your own private use, for as long as you follow these terms. The app is licensed to you, not sold.

The app, its design, the 3D body, the illustrations, the name Mezurio and its mark belong to us and are protected by law. Apart from the licence above, these terms give you no rights in them. The names of clothing brands and of the app stores belong to their owners.

06Your account

You do not need an account to use Mezurio. If you create one:

• give an email address that is yours, and keep your details up to date;
• keep your passphrase to yourself. You are responsible for what is done with your account;
• tell us at once at support@mezurioapp.com if you think someone else has used it;
• keep your passphrase somewhere safe. If you forget it we may not be able to let you back in, because we never hold it in a form we can read. What is on your phone stays yours either way.

You can delete your account in the app at any time.

07Your content, and other people’s measurements

It stays yours. Everything you enter in Mezurio remains yours. You give us permission to store it, to move it between your phones and to show it to the people you share it with, only so that the app can do what you asked of it. That permission ends when you delete the content or your account.

Other people. You may add other people: your family, your friends, a team. You are responsible for having the right to do so. Add only people who would expect you to have their measurements, and children only as their parent or guardian or with that person’s permission.

Sharing. When you share someone’s measurements, you decide who receives them. A link that has been sent cannot be taken back, so send it only to people you trust with what is in it.

08Acceptable use

You agree not to:

• use Mezurio to collect, store or share measurements of people who have not agreed to it;
• try to get into accounts or data that are not yours, or to disturb, overload or probe the service;
• copy, modify, resell, rent, reverse engineer or take apart the app, its 3D body or its artwork, except where the law says you may;
• use automated means to access the service, other than the app itself;
• use it for anything unlawful, or in a way that harms other people.

09Price

Mezurio has no paid features today. If we introduce any, the price and what it includes will be shown before you buy, the purchase will be handled by the app store you use under its own terms, and nothing will be charged without your clear agreement.

10If you got the app from the App Store or Google Play

This agreement is between you and us, not with Apple or Google. We, not they, are responsible for the app and its content. Your use of the app must also follow the terms of the store you downloaded it from.

For an app downloaded from the Apple App Store:

• Apple has no obligation to provide maintenance or support for the app;
• if the app fails to conform to a warranty that applies, you may tell Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app;
• Apple is not responsible for addressing claims by you or anyone else about the app, including product liability claims, claims that it fails to meet a legal requirement, and claims under consumer protection or privacy law;
• Apple is not responsible for investigating, defending or settling a claim that the app infringes someone’s intellectual property rights;
• you confirm that you are not in a country subject to a United States government embargo and are not on a United States government list of prohibited or restricted parties;
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

11Changes to the app, and ending

We keep working on Mezurio, so features can change, and some may be added or removed. We may also suspend or stop the service. We will try not to take away something people rely on without warning.

You can stop using Mezurio at any time: delete your account if you have one, and delete the app. Because your measurements live on your phone and can be exported, they do not depend on us.

We may suspend or close an account that is used to break these terms, to break the law, or to harm the service or other people. Where we reasonably can, we will tell you first and give you the chance to export your content.

12No warranty

We make Mezurio with care, but it is provided “as is” and “as available”. To the extent the law allows, we give no warranty, express or implied, that it will be uninterrupted, free of errors, secure, or fit for a particular purpose, or that any size, estimate or figure it shows is accurate.

13Limits on our liability

To the extent the law allows:

• we are not liable for indirect, incidental or consequential loss, or for loss of data, profit or opportunity;
• we are not liable for loss that comes from relying on an estimate the app made: a garment that does not fit, an order that had to be returned, a decision about health;
• our total liability to you for all claims about Mezurio is limited to the amount you paid us for it in the twelve months before the claim, or 50 US dollars if you paid nothing.

Nothing in these terms limits liability that cannot be limited by law, or takes away rights the law gives you as a consumer and that cannot be signed away.

14If your use causes a claim against us

If someone brings a claim against us because you added or shared another person’s information without the right to do so, or because you broke these terms or the law, you agree to cover the reasonable costs and losses we suffer as a result, to the extent the law allows.

15Governing law and disputes

These terms are governed by the laws of the United Arab Emirates. If you have a concern, please write to support@mezurioapp.com first: most problems can be settled that way, and we will try to resolve yours within 30 days.

If a dispute cannot be settled between us, the courts of the United Arab Emirates will have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in its courts where those laws give you that right.

16General

• Changes to these terms. We may update these terms. When we do, we will post the new version here and update the date at the top; for a change that matters, we will give notice in advance. If you keep using Mezurio after the new terms take effect, you accept them.
• The whole agreement. These terms and the privacy policy are the whole agreement between you and us about Mezurio.
• If part of it fails. If a court finds part of these terms unenforceable, the rest stays in force.
• No waiver. If we do not enforce a term at once, we may still enforce it later.
• Transfer. You may not transfer your rights under these terms to someone else. We may transfer ours to a publisher that takes over Mezurio.
• Language. These terms are written in English. If they are translated, the English version decides in case of a difference.
